Terms of Service

These Terms of Service ("Terms") govern your use of games made by smoothBrain Studios ("we", "us"), including CLOBBERFALL on the web, as a Discord Activity, and on desktop or mobile (together, the "Games"), and of this website. By playing the Games you agree to these Terms. If you don't agree, please don't play.

1. Who can play

You must be at least 13 years old, or the minimum age required in your country, to use the Games. If you play through Discord, you must also follow Discord's Terms of Service and Community Guidelines.

2. Your license

We give you a personal, non-exclusive, non-transferable, revocable license to play the Games for your own non-commercial entertainment. You may stream and share videos of the Games. You may not copy, sell, redistribute or reverse-engineer them, except where the law allows it.

3. Fair play and conduct

Don't:

• cheat, exploit bugs, or use tools to tamper with scores or the leaderboards;
• choose names that are offensive, hateful, impersonate others, or contain personal information;
• attack, overload or disrupt the Games, our servers or our providers; or
• use the Games for anything illegal.

We may remove scores or names, reset progress, or block access for anyone who breaks these rules.

4. In-game currency and items

Bonk Bucks, unlocks, cosmetics and other in-game items have no real-world value. They cannot be sold, transferred or exchanged for money, and we may change or rebalance them at any time.

5. Ownership

The Games and all of their content (code, art, audio, characters and names) belong to smoothBrain Studios. "CLOBBERFALL" and "smoothBrain Studios" are our names. Nothing in these Terms transfers ownership to you.

6. Third-party services

Parts of the Games use services run by others, including Discord, Unity Gaming Services and Cloudflare. Your use of those services is also subject to their terms, and we are not responsible for them.

7. Changes and availability

The Games are a work in progress. We may update, change or discontinue any part of them, including leaderboards and saved data, at any time and without notice.

8. Disclaimer

The Games are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We don't guarantee the Games will be uninterrupted, error-free, or that your progress will never be lost.

9. Limitation of liability

To the fullest extent permitted by law, smoothBrain Studios is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising from your use of the Games. Our total liability for any claim is limited to the amount you paid us for the Game in question, if any, in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you.

10. Termination

You can stop playing at any time. We may suspend or end your access if you break these Terms. Sections 4, 5 and 8–11 continue to apply after termination.

11. General

If any part of these Terms is found unenforceable, the rest still applies. Our not enforcing a term is not a waiver. These Terms are the whole agreement between you and us about the Games.

12. Changes to these Terms

We may update these Terms. We will change the effective date above, and continuing to play after a change means you accept the new Terms.
